Please read these Booking Terms and Conditions (hereinafter referred to as these Terms) carefully as by booking with Legend Travel Group you acknowledge that you have read and understood these Terms, and indicated your acceptance of and agreed to be bound by these Terms.
In case you confirm a booking with more than one client named and booked on such booking, you shall be deemed to accept these Terms on behalf of all clients named in the booking.
1. THE BOOKING CONTRACT.
The booking is confirmed and these Terms shall be applied when Legend Travel Group, or an authorized agent acting on behalf of Legend Travel Group, has already received the applicable deposit from the Client and the Client has received our written confirmation of such booking.
All dates, itineraries and prices are mentioned in the specific tour and package or detailed tailor-made offers.
3. DEPOSIT REQUIREMENT
After conclusion of the contract, a deposit of 5% to 10% of the travel fare is due. The deposit should be sent to the Tour Operator or authorized agent, as applicable.
Lifetime Deposits: If you cancel your booking, and that cancellation is not a result of nonpayment or any other breach of these Terms, Legend Travel Group will allow the customer to transfer his deposit payment into a lifetime deposit account, to be used any time for the rebooked or newly planned vacation with Legend Travel Group.
4. CLIENT DETAILS REQUIRED FOR BOOKING.
As a condition to valid confirmation of any booking with Legend Travel Group, the Client must provide all necessary information as requested by Legend Travel Group. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require the Client to complete and forward a Self-Assessment form. The Client shall bear all responsibilities and liabilities for any failure to obtain or provide such details due to the Client’s failure.
5. ACCEPTANCE OF BOOKING AND FINAL PAYMENT
The Client should refer to the confirmation invoice issued by Legend Travel Group and/or its authorized agent. In case you do the booking within 7 days of departure and your deposit is accepted, the contract will come into existence.
Regarding the final payment, in case the full payment is not done on or before the due date Legend Travel Group may treat the booking as cancelled.
6. LOCAL PAYMENT
This is a part of tour cost which is settled upon arrival. If your trip`s canceled in last minutes (even less than 24 hours) due to Covid-19 hinders travel or any reasons. You don`t have to pay for this fee.
7.1 Cancellation by Legend Travel Group.
If the full payment is not fulfilled by the due date, Legend Travel Group shall have the right to cancel the booking. In case Legend Travel Group, at the request of the Client, agrees to delay this cancellation and then, Legend Travel Group subsequently cancels for non-payment, the cancellation charges in Clause 4B shall be applied.
In the event that Legend Travel Group does not receive the minimum number of bookings to provide a certain tour, Legend Travel Group shall be entitled to cancel or curtail the tour at any time up to 1 week prior to the arrival of the Client. Legend Travel Group may offer an alternative date for the tour and the Client shall not be entitled to make a claim for loss arising as a consequence of cancellation or curtailment in these circumstances. Legend Travel Group shall notify the Client within seven days of cancellation or curtailment necessitated by the foregoing circumstances.
7.2 Cancellation by the Clients.
Cancellations will be charged as follows:
60 days or more prior to departure 5% of the cost of the tour, we will hold your deposit amount as a credit; Legend Travel Group will allow the customer to transfer his deposit payment into a lifetime deposit account, to be used any time for the rebooked or newly planned vacation with Legend Travel Group.
30-59 days prior departure: 10% of the cost of the tour is forfeited
15-29 days prior to departure: 20% of the cost of the tour is forfeited
7-14 days prior to departure: 50% of the cost of the tour is forfeited
Within 6 days prior to departure: 90 % of the cost of the tour is forfeited
7.3. Refund methods.
All money (following cancellation policy) will be refunded via Online Payment System if the Client makes deposit/payment by Credit Card via Internet. The Client will receive money within 3 – 4 days when Legend Travel Group does the refund. In case of deposit/payment by banking transfer via banks, the Client will receive money via bank accounts after one week when Legend Travel Group does the refund!
All the Client’s rights will be properly protected by Legend Travel Group.
8. BOOKING AMENDMENTS
Amendments to any other arrangements made in conjunction with your trip/tour will incur at least or more than U.S $10 administration fee for a change per booking. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 10 days of departure.
9. PRICES & SURCHARGES
Our trip prices are subject to variable and seasonal pricing, both of which are of standard practice in the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different clients on the same trip may have been charged differently.
Your best decision is to book at the time you are satisfied with the price. Once you have received a quote, the price will be locked in until you pay the required deposit prior to the quote’s expiry. Any reduced pricing or discounts that may become available after you have made your deposit will not apply.
If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply. The most up-to-date pricing is available on our website. We reserve the right to impose surcharges up to 45 days before departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government should require us to do so. In such instances we will be responsible for the any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price, you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity of this brochure once paid in full. Air Passenger Duty is included in the price of your air inclusive trip. In view of the current volatility of world oil prices, a fuel supplement may be added to the price of your holiday at the time of booking. Please note that a levy of up to 2.35% may be applied to all purchases made by credit card.
10. AGE & HEALTH REQUIREMENTS
10.1 Minimum General Policy:
For the majority of our trips the minimum age is 6 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18 with today’s care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.
Please take a note that Legend Travel Group cannot guarantee triple or joining rooms for families, and accompanying adults may be required to share with others in the group on a twin share basis.
10.2 Maximum General Policy:
For the majority of our trips we have no upper age limit though we remind you that our trips can be physically demanding and the Clients must ensure that they are suitably fit to allow full participation. We are able to provide details on mandatory health requirements. It is our responsibility to suggest that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.
11. PASSPORTS AND VISAS
The Client must show a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip; please refer to the website for details. We are not responsible if your entry to a country is not accepted due to the correct passport, visa or other travel documentation.

12. TRAVEL INSURANCE
The Client is required to have full travel insurance. It is the responsibility of the Client to read the insurance policy before they travel and ensures that the insurance scheme provides the Client with the requisite level of cover.
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
14. CHANGE OF ITINERARY
While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
14.1 Before departure:
If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.
14.2 After departure:
We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
15. AUTHORITY ON TOURS
Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
16. ACCEPTANCE OF RISK
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
17. LIMITATION OF LIABILITY
Legend Travel Group contracts with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
17.1 Legend Travel Group is not responsible for any loss, injury or damage sustained by the Client. Additional expenses incurred due to delays, accidents, natural disaster, political actions and unrest must be borne by the Client.
17.2 Legend Travel Group shall not be liable for any damage caused to the Client by the failure to process the contract or the improper performance of the contract where the failure or the improper performance is due neither to the fault of Indochina legend because of the following cases:
The failure occurring in the performance of the contract is attributable to the Client; or
The failure is attributable to a third party unconnected with the provision of the services contracted for and are unforeseeable or unavoidable;
18. CLAIMS & COMPLAINTS
In case the Client has got any complaint about your trip, please inform your group leader or our local representative at the time in order that they can attempt to rectify the matter. When satisfaction is not reached through these means, any further complaint should be put in writing to us within 30 days of the end of the tour.
19. PHOTOS AND MARKETING
The Client consents to us using images/photos of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
Any of your personal information we get may be used for any purpose associated with the operation of a Trip or to send you marketing materials in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip.
